PERSONAL DATA PROTECTION POLICY FOR CUSTOMERS

With Viet Nam Payment Solution Joint Stock Company (hereinafter referred to as "VNPAY"), protecting our customers' personal data is of paramount importance. We constantly update and implement advanced technological measures adhering to the most optimal security practices. These efforts are undertaken with the highest level of diligence, sense of responsibility, and caution to safeguardyour rights and interests.

Tại Công ty cổ phần Giải pháp Thanh toán Việt Nam (sau đây gọi tắt là "VNPAY"), bảo vệ Dữ liệu cá nhân của Quý khách là công việc tối quan trọng và luôn được chúng tôi cập nhật, áp dụng các biện pháp công nghệ tiên tiến, theo thông lệ bảo mật tối ưu nhất với nỗ lực, tinh thần trách nhiệm cũng như ý thức cẩn trọng cao nhất nhằm đảm bảo quyền, lợi ích hợp pháp của Quý khách.

VNPAY hereby respectfully announces the Personal Data Protection Policy for Customers (hereinafter referred to as the "Personal Data Protection Policy") issued by VNPAY and effective from January 10 ^th , 2026. This Personal Data Protection Policy applies to VNPAY's activities related to the protection of your personal data.

VNPAY xin trân trọng thông báo tới Quý khách bản Chính sách Bảo vệ Dữ liệu cá nhân dành cho Khách hàng (sau đây gọi tắt là "Chính sách Bảo vệ Dữ liệu cá nhân") được VNPAY ban hành và có hiệu lực kể từ ngày 10/01/2026. Chính sách Bảo vệ Dữ liệu cá nhân này áp dụng đối với các hoạt động của VNPAY liên quan tới việc bảo vệ Dữ liệu cá nhân của Quý khách.

1. GENERAL PROVISIONS /CÁC QUY ĐỊNH CHUNG

By registering for or using VNPAY's products or services or by entering into agreements, and/or allowing VNPAY to use and process your personal data, you accept all terms outlined in this Personal Data Protection Policy.

Bằng việc đăng ký sử dụng, sử dụng các sản phẩm, dịch vụ của VNPAY, hoặc bằng việc xác lập các thỏa thuận và/hoặc cho phép VNPAY sử dụng thông tin cá nhân, xử lý Dữ liệu cá nhân của Quý khách, Quý khách chấp nhận toàn bộ các quy định được đề cập tại Chính sách Bảo vệ Dữ liệu cá nhân này.

VNPAY will only collect, use, store, and process your personal data in accordance with the provisions of: (i) laws on personal data protection (including but not limited to the Law on Personal Data Protection No. 91/2025/QH15 dated June 26, 2025 and subordinate legislation guiding, amending, supplementing, or replacing from time to time); (ii) this Personal Data Protection Policy; and (iii) any contracts or agreements between you and VNPAY.

VNPAY chỉ thu thập, sử dụng, lưu trữ, xử lý Dữ liệu cá nhân của Quý khách phù hợp với quy định của (i) pháp luật về bảo vệ Dữ liệu cá nhân (bao gồm nhưng không giới hạn Luật Bảo vệ Dữ liệu cá nhân số 91/2025/QH15 ngày 26 tháng 6 năm 2025 và các văn bản quy phạm pháp luật hướng dẫn, sửa đổi, bổ sung, thay thế tại từng thời kỳ); (ii) Chính sách Bảo vệ Dữ liệu cá nhân này; và (iii) hợp đồng, thỏa thuận khác giữa Quý khách và VNPAY.

By providing VNPAY with personal data of a third party (such as information about your spouse, children, and/or parents and/or guardians, friends, beneficiaries, authorized persons, partners, guarantors, emergency contacts, legal representatives, chief accountants, contact points, shareholders, or other individuals related to you), you represent and warrant that you have fully informed the third party about the contents of this Personal Data Protection Policy and obtained their lawful consent for VNPAY to process their personal data for the purposes specified in this Personal Data Protection Policy. Additionally, you understand that VNPAY is not obliged to re-verify this consent.

Bằng việc cung cấp cho VNPAY Dữ liệu cá nhân của một bên thứ ba (như thông tin vợ, chồng, con và/hoặc cha mẹ và/hoặc người giám hộ, bạn bè, bên thụ hưởng, người được ủy quyền, đối tác, bên bảo đảm, người liên hệ trong các trường hợp khẩn cấp, người đại diện theo pháp luật, kế toán trưởng, đầu mối liên hệ, cổ đông hoặc cá nhân khác có liên quan đến Quý khách), Quý khách cam đoan và đảm bảo rằng Quý khách đã cung cấp thông tin đầy đủ về nội dung của Chính sách Bảo vệ Dữ liệu cá nhân này cho bên thứ ba và có được sự đồng ý hợp pháp của bên thứ ba đó để VNPAY xử lý các Dữ liệu cá nhân cho các mục đích được nêu tại Chính sách Bảo vệ Dữ liệu cá nhân này. Đồng thời, Quý khách hiểu rằng, VNPAY sẽ không cần thẩm định lại sự chấp thuận này.

Depending on VNPAY's role in each specific situation, whether as (i) personal data controller; (ii) personal data processor; or (iii) personal data controller and processor, VNPAY will exercise the corresponding rights and obligations as prescribed by applicable law.

Tùy thuộc vào vai trò của VNPAY trong từng tình huống cụ thể, là (i) Bên kiểm soát Dữ liệu cá nhân; (ii) Bên xử lý Dữ liệu cá nhân; hoặc (iii) Bên kiểm soát và xử lý Dữ liệu cá nhân, VNPAY sẽ thực hiện các quyền hạn và nghĩa vụ tương ứng theo quy định của pháp luật hiện hành.

VNPAY would like to note that the processing of necessary Personal Data is essential for VNPAY to fulfill its quality commitments and ensure the safety and availability of its products and services.

VNPAY xin lưu ý rằng để VNPAY có thể thực hiện các cam kết về chất lượng và đảm bảo tính an toàn, sẵn sàng của sản phẩm, dịch vụ, việc xử lý các Dữ liệu cá nhân cần thiết.

2. SCOPE AND CATEGORIESOF PERSONAL DATA PROCESSED/ PHẠM VI, LOẠI DỮ LIỆU CÁ NHÂN ĐƯỢC XỬ LÝ

To fulfill your requests (including but not limited to requests for e-wallet services, other products, and services) and/or to provide general information about VNPAY's products/utilities, VNPAY and the personal data processors with whom VNPAY enters into an agreement will need to use your personal data (the processing of Personal Data referred to in this Personal Data Protection Policy shall be understood to include, but not limited to, the following activities: usage, sharing, disclosure, collection, recording, analysis, aggregation, encryption, decryption, modification, erasure, destruction, de-identification, provision, publication, transfer of Personal Data, and other activities impacting Personal Data).

Để có thể thực hiện các yêu cầu của Quý khách (bao gồm nhưng không giới hạn các yêu cầu cung cấp dịch vụ ví điện tử, các sản phẩm và dịch vụ khác) và/hoặc cung cấp khái quát thông tin các sản phẩm/tiện ích của VNPAY, VNPAY và bên xử lý Dữ liệu cá nhân mà VNPAY có thỏa thuận cần phải sử dụng Dữ liệu cá nhân của Quý khách (Hoạt động xử lý Dữ liệu cá nhân được đề cập tại Chính sách Bảo vệ Dữ liệu cá nhân này được hiểu là bao gồm nhưng không giới hạn các hoạt động: sử dụng, chia sẻ, tiết lộ, thu thập, phân tích, tổng hợp, mã hóa, giải mã, chỉnh sửa, xóa, hủy, khử nhận dạng, cung cấp, công khai, chuyển giao Dữ liệu cá nhân và hoạt động khác tác động đến Dữ liệu cá nhân).

Types of personal data VNPAY collects and processes may include sensitive personal data. The types of your personal data that may be collected and processed are listed below and may vary depending on the time and relationship between you and VNPAY (hereinafter referred to as the "Personal Data"):

Dữ liệu cá nhân của Quý khách được thu thập, xử lý có thể bao gồm cả Dữ liệu cá nhân nhạy cảm của Quý khách. Các loại Dữ liệu cá nhân của Quý khách có thể được thu thập, xử lý là các loại thông tin được liệt kê dưới đây và có thể thay đổi tùy thuộc vào từng thời điểm và mối quan hệ của Quý khách với VNPAY (được gọi là "Dữ liệu cá nhân"):

(i) Basic Personal Data: Surname, middle name, and given name; other names (if any); Date of birth; Date of death or date of missing; Gender; Place of birth, Place of registration of birth, place of permanent residence, place of temporary residence, current residence, hometown, contact address; Nationality; Personal image; Phone number, personal identification number, passport number, driver's license number, license plate number; Marital status; Family relationship information (parents, spouse, children); Personal digital account information; Personal data reflecting activities and activity history in cyberspace; other information associated with a specific individual or which helps identify a specific individual that does not fall within the scope of Sensitive Personal Data as prescribed in Section 2(ii) below.

(i) Dữ liệu cá nhân cơ bản: Họ, chữ đệm và tên khai sinh, tên gọi khác (nếu có); ngày, tháng, năm sinh; ngày, tháng, năm chết hoặc mất tích; giới tính; nơi sinh, nơi đăng ký khai sinh, nơi thường trú, nơi đăng ký tạm trú, nơi ở hiện tại, quê quán, địa chỉ liên hệ; quốc tịch; hình ảnh của cá nhân; số điện thoại, số định danh cá nhân, số hộ chiếu, số giấy phép lái xe, số biển số xe; tình trạng hôn nhân; thông tin về mối quan hệ gia đình (cha mẹ, con, vợ, chồng); thông tin về tài khoản số của cá nhân; các thông tin khác gắn liền với một con người cụ thể hoặc giúp xác định một con người cụ thể không thuộc phạm vi Dữ liệu cá nhân nhạy cảm theo quy định tại Mục 2(ii) dưới đây.

(ii) Sensitive Personal Data: Data revealing racial or ethnic origin; political opinions, religious or philosophical beliefs; information on private life, personal secrets, and family secrets; health status; biometric data, genetic characteristics; data revealing an individual's sex life or sexual orientation; data concerning criminal offenses and law violations collected and stored by law enforcement agencies; an individual's location identified via location-based services; username and password for an individual's electronic identification account; images of Identity Cards, Citizen Identity Cards, or People's Identity Cards; username and password of bank accounts; bank card information and bank account transaction history data; financial and credit information; data on financial, securities, and insurance activities and transaction history of the customer at credit institutions, foreign bank branches, payment intermediary service providers, securities and insurance entities, and other authorized organizations; data tracking behaviors and activities related to the use of telecommunications services, social networks, online media services, and other services in cyberspace; other personal data specified by law as requiring confidentiality or stringent security measures.

(ii) Dữ liệu cá nhân nhạy cảm: Dữ liệu tiết lộ nguồn gốc chủng tộc, nguồn gốc dân tộc; quan điểm chính trị, tôn giáo, tín ngưỡng; thông tin về đời sống riêng tư, bí mật cá nhân, bí mật gia đình; tình trạng sức khỏe; dữ liệu sinh trắc học, đặc điểm di truyền; dữ liệu tiết lộ đời sống tình dục, xu hướng tình dục của cá nhân; dữ liệu về tội phạm, vi phạm pháp luật được thu thập, lưu trữ bởi các cơ quan thực thi pháp luật; vị trí của cá nhân được xác định qua dịch vụ định vị; thông tin tên đăng nhập và mật khẩu truy cập tài khoản định danh điện tử của cá nhân; hình ảnh thẻ căn cước, thẻ căn cước công dân, chứng minh nhân dân; tên đăng nhập, mật khẩu truy cập của tài khoản ngân hàng; thông tin thẻ ngân hàng, dữ liệu về lịch sử giao dịch của tài khoản ngân hàng; thông tin tài chính, tín dụng và các thông tin về hoạt động, lịch sử giao dịch tài chính, chứng khoán, bảo hiểm của khách hàng tại các tổ chức tín dụng, chi nhánh ngân hàng nước ngoài, tổ chức cung ứng dịch vụ trung gian thanh toán, chứng khoán, bảo hiểm, các tổ chức được phép khác; dữ liệu theo dõi hành vi, hoạt động sử dụng dịch vụ viễn thông, mạng xã hội, dịch vụ truyền thông trực tuyến và các dịch vụ khác trên không gian mạng; dữ liệu cá nhân khác được pháp luật quy định cần giữ bí mật hoặc cần có biện pháp bảo mật chặt chẽ.

(iii) Information concerning the process of purchasing and using products, goods, and services, and other information related to transactions between the Customer and VNPAY.

(iii) Các thông tin về quá trình mua, sử dụng sản phẩm, hàng hóa, dịch vụ của Quý khách và thông tin khác liên quan đến giao dịch giữa Quý khách và VNPAY.

(iv) And other personal data as prescribed by law that you provide to VNPAY when registering for VNPAY's products and services, as well as data generated during your use of the products and services.

(iv) Các dữ liệu cá nhân khác theo quy định của pháp luật được Quý khách cung cấp cho VNPAY khi đăng ký sử dụng sản phẩm, dịch vụ cũng như dữ liệu phát sinh trong quá trình Quý khách sử dụng sản phẩm, dịch vụ của VNPAY.

3. PURPOSES OF PERSONAL DATA PROCESSING/ MỤC ĐÍCH XỬ LÝ DỮ LIỆU CÁ NHÂN

VNPAY may collect and process your personal data and share results of the personal data processing for the purposes related to the provision of products and services, including but not limited to:

VNPAY có thể thu thập, xử lý Dữ liệu cá nhân của Quý khách và chia sẻ kết quả xử lý Dữ liệu cá nhân cho các mục đích liên quan tới việc cung cấp sản phẩm, dịch vụ, bao gồm nhưng không giới hạn:

(i) To evaluate and provide you with VNPAY's products and services, as well as products and services that VNPAY cooperates with partners;

(i) Đánh giá và cung cấp các sản phẩm, dịch vụ của VNPAY và sản phẩm, dịch vụ VNPAY hợp tác với đối tác cho Quý khách;

(ii) To identify, verify, and maintain accurate information about your identity; ensure the security and safety of VNPAY's information systems and other due diligence requirements in accordance with the law;

(ii) Nhận biết, xác minh và duy trì thông tin chính xác về nhận biết Quý khách; đảm bảo an ninh và an toàn hệ thống thông tin của VNPAY và các yêu cầu thẩm định khách hàng khác với Quý khách theo quy định pháp luật;

(iii) To support you and update the your information when registering for and using the products and services provided by VNPAY or VNPAY's partners;

(iii) Hỗ trợ Quý khách, cập nhật thông tin Quý khách khi đăng ký sử dụng, sử dụng sản phẩm, dịch vụ do VNPAY hoặc đối tác của VNPAY cung cấp;

(iv) To fulfill obligations under contracts or agreements between you and VNPAY (if any);

(iv) Thực hiện các nghĩa vụ theo hợp đồng, thỏa thuận giữa VNPAY và Quý khách (nếu có);

(v) To assess risks, analyze trends, perform statistical analysis, and develop plans, including data analysis on statistics, credit, and anti-money laundering;

(v) Đánh giá rủi ro, phân tích xu hướng, thống kê, lên kế hoạch, bao gồm phân tích xử lý dữ liệu về thống kê, tín dụng và phòng chống rửa tiền;

(vi) To detect, prevent, and investigate crimes, attacks, or violations, including fraud, money laundering, terrorism, financing the proliferation of weapons of mass destruction, bribery, corruption, or tax evasion;

(vi) Phát hiện, ngăn chặn, và điều tra tội phạm, tấn công hoặc vi phạm bao gồm cả gian lận, rửa tiền, khủng bố, tài trợ phổ biến vũ khí hủy diệt hàng loạt, hối lộ, tham nhũng hoặc trốn thuế;

(vii) To organize marketing and promotional activities, market research, public opinion surveys, brokerage, product introductions, and advertising; to directly or indirectly conduct marketing of the products and services to you, and conduct promotional programs, gift exchanges, prize awards, and gift deliveries.

(vii) Tổ chức giới thiệu và xúc tiến thương mại, nghiên cứu thị trường, thăm dò dư luận, môi giới, giới thiệu sản phẩm, quảng cáo; liên hệ với Quý khách, tiếp thị trực tiếp, gián tiếp các sản phẩm, dịch vụ với Quý khách, thực hiện các chương trình khuyến mại, đổi quà, trao thưởng, giao quà tặng;

(viii) To record your credibility in using services to improve the quality of the products and services, as well as to organize loyalty customer programs to bring the best consumer benefits to you;

(viii) Ghi nhận tín nhiệm sử dụng dịch vụ của Quý khách để hỗ trợ cho việc cung cấp các sản phẩm, dịch vụ của VNPAY cho Quý khách một cách tốt nhất, cũng như tổ chức các chương trình khách hàng thường xuyên, khách hàng thân thiết, nhằm mang đến lợi ích tiêu dùng tốt nhất tới Quý khách;

(ix) To aggregate, analyze, research, and develop new products and services, and to provide you with suitable products and services;

(ix) Tổng hợp, phân tích, nghiên cứu, phát triển các sản phẩm, dịch vụ mới và cung cấp các sản phẩm, dịch vụ phù hợp cho Quý khách;

(x) To evaluate and improve the quality of the products and services that VNPAY provides to customers. To develop new features and products, and to support payment and financial solutions related to VNPAY's services;

(x) Đánh giá để cải thiện và nâng cao chất lượng sản phẩm, dịch vụ mà VNPAY cung cấp cho Quý khách. Phát triển các tính năng và sản phẩm mới và hỗ trợ các giải pháp thanh toán và tài chính liên quan đến các dịch vụ của VNPAY;

(xi) To verify your information to ensure the security of your account in response to inquiries, investigations, and complaints.

(xi) Xác minh thông tin khách hàng nhằm bảo mật an toàn về tài khoản của Quý khách trong các yêu cầu giải đáp thắc mắc, tra soát và khiếu nại.

(xii) To protect or enforce VNPAY's lawful rights and interests, including the right to collect fees, recover and handle debts that you owe to VNPAY.

(xii) Bảo vệ hoặc thực thi các quyền và lợi ích hợp pháp của VNPAY, bao gồm quyền thu các khoản phí, thu hồi và xử lý các khoản nợ mà Quý khách đang nợ VNPAY .

In cases where you have consented to VNPAY collecting and processing your personal data for the purposes of marketing and advertising products, you agrees that VNPAY has the right to market and introduce products as follows:

Trường hợp Quý khách đã đồng ý cho phép VNPAY thu thập, xử lý Dữ liệu cá nhân của mình cho mục đích tiếp thị, giới thiệu sản phẩm, Quý khách đồng ý rằng VNPAY có quyền tiếp thị, giới thiệu sản phẩm theo nội dung, hình thức, tần suất như sau:

(i) Scope: Marketing and introducing products of VNPAY and its partners.

(i) Nội dung: Tiếp thị, giới thiệu sản phẩm của VNPAY và đối tác.

(ii) Method: Through advertising messages, notifications on VNPAY's official websites, applications, or other methods as regulated by law.

(ii) Phương thức: Qua tin nhắn quảng cáo, thông báo trên websites chính thức, ứng dụng của VNPAY hoặc các phương thức khác theo quy định của pháp luật.

(iii) Form: VNPAY sends directly to you through the internet, electronic devices, electronic means, or other forms as regulated by law.

(iii) Hình thức: VNPAY gửi trực tiếp cho Quý khách qua không gian mạng, thiết bị, phương tiện điện tử hoặc các hình thức khác theo quy định của pháp luật.

(iv) Frequency: According to advertising regulations stipulated by law.

(iv) Tần suất: Theo quy định pháp luật về quảng cáo.

4. METHODS OF PERSONAL DATA PROCESSING/ CÁCH THỨC XỬ LÝ DỮ LIỆU CÁ NHÂN

Your personal data may be processed as follows:

Dữ liệu cá nhân của Quý khách có thể được xử lý:

(i) Manually; and/or

(i) Bằng tay; và/hoặc

(ii) Automatically (via electronic means); and/or

(ii) Tự động (bằng phương tiện điện tử); và/hoặc

(iii) Other appropriate methods as prescribed by the law.

(iii) Cách thức khác phù hợp với quy định của pháp luật.

5. PERSONAL DATA CONTROLLER AND PROCESSOR/ THÔNG TIN VỀ BÊN KIỂM SOÁT VÀ XỬ LÝ DỮ LIỆU CÁ NHÂN

5.1. The Personal Data Controller and Processor shall be VNPAY and/or VNPAY's partners involved in the provision of VNPAY's products and services.

5.1. Bên kiểm soát và xử lý Dữ liệu cá nhân là VNPAY và/hoặc đối tác của VNPAY có tham gia vào quá trình cung cấp sản phẩm, dịch của VNPAY.

5.2. To enhance customer's experience and enable VNPAY to fulfill the purposes of using personal data under this Personal Data Protection Policy, VNPAY may disclose your personal data with the following organizations or individuals:

5.2. Nhằm phục vụ trải nghiệm của Quý khách và để VNPAY có thể thực hiện các mục đích sử dụng Dữ liệu cá nhân theo Chính sách Bảo vệ Dữ liệu cá nhân này, Quý khách đồng ý cho VNPAY có thể chia sẻ Dữ liệu cá nhân của Quý khách cho các tổ chức, cá nhân sau đây:

(i) VNPAY's products, services providers, including but not limited to information technology services, marketing services, market research services, training services, legal services, auditing services, transportation services;

(i) các nhà cung cấp sản phẩm, dịch vụ cho VNPAY, bao gồm và không giới hạn ở các dịch vụ công nghệ thông tin, các dịch vụ marketing, khảo sát thị trường, các dịch vụ đào tạo, dịch vụ pháp lý, dịch vụ kiểm toán, dịch vụ vận chuyển;

(ii) VNPAY's consulting firms, auditors, law firms, lawyers;

(ii) các công ty tư vấn, bên kiểm toán, tổ chức hành nghề luật sư, luật sư của VNPAY;

(iii) financial partners, commercial banks, switch organizations, card organizations, payment intermediary companies cooperating with VNPAY;

(iii) các đối tác tài chính, các ngân hàng thương mại, tổ chức chuyển mạch, tổ chức thẻ, các công ty trung gian thanh toán có quan hệ hợp tác với VNPAY;

(iv) merchants accepting VNPAY's payment services, users of VNPAY's payment intermediary services, e-commerce trading platform services of VNPAY;

(iv) các đơn vị chấp nhận thanh toán, bên sử dụng dịch vụ trung gian thanh toán, dịch vụ sàn giao dịch thương mại điện tử của VNPAY;

(v) employees, staff of VNPAY;

(v) nhân viên, người lao động của VNPAY;

(vi) VNPAY's parent company, subsidiaries company, and affiliated companies;

(vi) công ty mẹ, công ty con và công ty liên kết của VNPAY;

(vii) Any individual, competent authority, regulatory agency, or third party to whom VNPAY is permitted or required to disclose data under the laws of any country, or pursuant to any contract or commitment between the third party and VNPAY;

(vii) bất kỳ cá nhân, cơ quan có thẩm quyền hoặc cơ quan quản lý hoặc bên thứ ba mà VNPAY được phép hoặc bắt buộc phải tiết lộ theo quy định pháp luật của bất kỳ quốc gia, hoặc theo bất kỳ hợp đồng hoặc cam kết nào khác giữa bên thứ ba và VNPAY;

(viii) any individual involved in the enforcement or maintenance of any rights or obligations under the agreements between the you and VNPAY;

(viii) bất kỳ cá nhân có liên quan đến việc thực thi hoặc duy trì bất kỳ quyền hoặc nghĩa vụ nào theo (các) thỏa thuận giữa Quý khách với VNPAY;

(ix) VNPAY's service providers, and to whom the sharing or disclosing of data is necessary for VNPAY to fulfill its obligations to you;

(ix) các bên cung cấp dịch vụ cho VNPAY mà việc chia sẻ, tiết lộ dữ liệu cho họ là cần thiết để VNPAY có thể thực hiện các nghĩa vụ của mình đối với Quý khách;

(x) third parties responsible for processing personal data under contracts or agreements with VNPAY, including research companies, survey firms, and rating agencies;

(x) các bên thứ ba chịu trách nhiệm xử lý dữ liệu đối với các Dữ liệu cá nhân theo hợp đồng, thỏa thuận của họ với VNPAY, bao gồm cả các công ty nghiên cứu, khảo sát và cơ quan xếp hạng;

(xi) competent state agencies;

(xi) các cơ quan Nhà nước có thẩm quyền;

(xii) parties that you have consented to, or that VNPAY has a legal basis to share your personal data.

In addition to the aforementioned cases, VNPAY will not disclose your personal data to any other party, unless:

Ngoài các trường hợp trên, VNPAY sẽ không tiết lộ Dữ liệu cá nhân của Quý khách cho bất kỳ bên nào khác trừ khi:

(i) you have consented to it;

(ii) VNPAY is required or permitted to disclose pursuant to the law;

6. POSSIBLE UNINTENDED CONSEQUENCES AND DAMAGES/ HẬU QUẢ, THIỆT HẠI KHÔNG MONG MUỐN CÓ KHẢ NĂNG XẢY RA

VNPAY uses various information security technologies such as international standard PCI DSS, SSL... to protect customer's personal data from being disclosured, exploited, used, or shared without your consent. VNPAY undertakes to maximize the security and confidentiality of your personal data.

However, some unintended consequences and damages that may occur include, but are not limited to the following reasons: (a) Hardware or software errors during data processing; (b) Security vulnerabilities beyond VNPAY's control, and the system is hacked; (c) Your own subjective negligence, being scammed, or accessing websites/downloading applications containing malware; (d) Natural disasters...

Tuy nhiên, một số hậu quả, thiệt hại không mong muốn có thể xảy ra bao gồm nhưng không giới hạn bởi các nguyên nhân sau: (a) Lỗi phần cứng, phần mềm trong quá trình xử lý dữ liệu; (b) Lỗ hổng bảo mật nằm ngoài khả năng kiểm soát của VNPAY, hệ thống bị tin tặc tấn công; (c) Quý khách chủ quan, bất cẩn hoặc bị lừa đảo hoặc truy cập các website/tải các ứng dụng có chứa phần mềm độc hại; (d) thảm họa thiên nhiên... VNPAY advises you to keep the information related to your username, passwords, OTP codes, and biometric data secure and not to share this information with anyone else.

VNPAY khuyến cáo Quý khách bảo mật các thông tin liên quan đến tên đăng nhập, mật khẩu đăng nhập vào tài khoản của Quý khách, mã OTP, sinh trắc học và không chia sẻ các thông tin này với bất kỳ người nào khác.

Customers should protect your electronic devices while using. You should lock, log out, or exit the accounts on VNPAY's website or application when not in use.

Quý khách nên bảo quản thiết bị điện tử trong quá trình sử dụng. Quý khách nên khóa, đăng xuất, hoặc thoát khỏi tài khoản trên website hoặc ứng dụng của VNPAY khi không có nhu cầu sử dụng tài khoản.

In the event of an incident or detection of a violation concerning your personal data, VNPAY will promptly notify the relevant State authorities of the personal data protection breach and make every effort to implement remedial measures to prevent further consequences.

Trong trường hợp xảy ra sự cố hoặc phát hiện hành vi vi phạm đến Dữ liệu cá nhân của Quý khách, VNPAY sẽ ngay lập tức tiến hành thông báo vi phạm quy định về bảo vệ Dữ liệu cá nhân cho cơ quan Nhà nước có thẩm quyền và nỗ lực thực hiện các biện pháp khắc phục, ngăn chặn hậu quả.

7. START AND END TIME OF PERSONAL DATA PROCESSING/ THỜI GIAN BẮT ĐẦU, THỜI GIAN KẾT THÚC XỬ LÝ DỮ LIỆU CÁ NHÂN

Start time of the personal data processing: From the time you accept this Personal Data Protection Policy or when you register to use or use VNPAY's products or services.

Thời gian bắt đầu xử lý Dữ liệu cá nhân: Kể từ thời điểm Quý khách chấp thuận Chính sách Bảo vệ Dữ liệu cá nhân này hoặc tại thời điểm Quý khách đăng ký sử dụng hoặc sử dụng sản phẩm, dịch vụ của VNPAY.

End time of the personal data processing: Until the time VNPAY is requested by you to stop the processing of your personal data, or when VNPAY no longer has any obligations to provide products or services to you, or any another time as prescribed by law.

Thời gian kết thúc xử lý Dữ liệu cá nhân: Cho tới thời điểm Quý khách yêu cầu VNPAY chấm dứt việc xử lý Dữ liệu cá nhân hoặc khi VNPAY không còn bất kỳ nghĩa vụ nào về việc cung cấp sản phẩm, dịch vụ cho Quý khách hoặc thời gian khác theo quy định của pháp luật.

8. RIGHTS AND OBLIGATIONS OF CUSTOMERS/ QUYỀN VÀ NGHĨA VỤ CỦA QUÝ KHÁCH

8.1 As the of personal data subject, you have the following rights:

(i) The right to be informed of Personal Data processing activities;

(ii) The right to consent, withhold consent, or request the withdrawal of consent for Personal Data processing;

(iii) The right to access, rectify, or request the rectification of Personal Data;

(iv) The right to request data provision, erasure, or restriction of Personal Data processing; and to object to Personal Data processing;

(v) The right to complain, denounce, initiate lawsuits, and claim damages in accordance with the law;

(vi) The right to request competent authorities or relevant agencies, organizations, and individuals involved in Personal Data processing to implement measures and solutions to protect their Personal Data in accordance with the law;

(xi) Other rights as prescribed by law from time to time.

8.1. Với tư cách là chủ thể Dữ liệu cá nhân, Quý khách có các quyền sau:

(i) Được biết về hoạt động xử lý Dữ liệu cá nhân;

(ii) Đồng ý hoặc không đồng ý, yêu cầu rút lại sự đồng ý cho phép xử lý Dữ liệu cá nhân;

(iii) Xem, chỉnh sửa hoặc yêu cầu chỉnh sửa Dữ liệu cá nhân;

(iv) Yêu cầu cung cấp, xóa, hạn chế xử lý Dữ liệu cá nhân; gửi yêu cầu phản đối xử lý Dữ liệu cá nhân;

(v) Khiếu nại, tố cáo, khởi kiện, yêu cầu bồi thường thiệt hại theo quy định của pháp luật;

(vi) Yêu cầu cơ quan có thẩm quyền hoặc cơ quan, tổ chức, cá nhân liên quan đến xử lý Dữ liệu cá nhân thực hiện các biện pháp, giải pháp bảo vệ Dữ liệu cá nhân của mình theo quy định của pháp luật;

(xi) Các quyền khác theo quy định của pháp luật tại từng thời kỳ.

8.2 To the extent permitted by law, you may exercise your rights by: (i) Directly performing operations on VNPAY's product and service delivery platforms; or (ii) Contacting VNPAY using the contact information provided in Clause 10 below. VNPAY will comply with any legitimate and valid requests from Customers within the legally prescribed timeframe after receiving your valid request.

8.2. Trong phạm vi pháp luật cho phép, Quý khách có thể thực hiện các quyền của mình bằng cách: (i) thao tác trực tiếp các trên nền tảng cung cấp sản phẩm, dịch vụ của VNPAY hoặc (ii) liên hệ với VNPAY theo thông tin được cung cấp chi tiết tại Mục 10 bên dưới. VNPAY sẽ thực hiện yêu cầu hợp pháp và hợp lệ từ Quý khách trong khoảng thời gian quy định của pháp luật kể từ khi nhận được yêu cầu hợp lệ từ Quý khách.

8.3 In the event that you withdraw the consent to the processing of your personal data, request the data deletion, or exercise other related rights with respect to any or all of the personal data, these actions may: (i) affect the legal validity of the contract and the legal relation between you and VNPAY; (ii) VNPAY's products and services being limited, restricted, suspended, or canceled in specific cases. These changes may lead to costs or damages that you and/or third parties may incur. VNPAY will continue to process your personal data within the remaining scope required (if any) or as stipulated by law.

8.3 Trường hợp Quý khách rút lại sự đồng ý của mình về việc xử lý Dữ liệu cá nhân, yêu cầu xóa dữ liệu, thực hiện các quyền có liên quan khác đối với bất kỳ hoặc tất cả các Dữ liệu cá nhân của Quý khách thì các hành động đó có thể làm: (i) ảnh hưởng đến hiệu lực pháp lý của hợp đồng, quan hệ pháp lý của VNPAY và Quý khách; (ii) sản phẩm, dịch vụ của VNPAY đối với Quý khách bị giới hạn, hạn chế, tạm ngừng, hủy bỏ tùy từng trường hợp. Việc thay đổi này có thể dẫn đến các phí tổn, thiệt hại mà Quý khách và/hoặc bên thứ ba sẽ phải gánh chịu. VNPAY sẽ tiếp tục xử lý Dữ liệu cá nhân của Quý khách trong phạm vi còn lại được yêu cầu (nếu có) hoặc theo quy định của pháp luật.

8.4 Obligations of customers:

Với tư cách là chủ thể Dữ liệu cá nhân, Quý khách có các nghĩa vụ sau:

(i) To comply with the regulations of the law, this Personal Data Protection Policy, and VNPAY's rules and guidelines related to the processing of customer's personal data.

(i) Tuân thủ các quy định của pháp luật, Chính sách Bảo vệ Dữ liệu cá nhân này và các quy định, hướng dẫn của VNPAY liên quan đến xử lý Dữ liệu cá nhân của Quý khách.

(ii) To provide complete, truthful, and accurate personal data and other information as required by VNPAY when registering for and using VNPAY's products and services, and when there are changes to this information. VNPAY will secure your personal data based on the information you have registered. VNPAY, therefore, will not be responsible for any consequences or limitations to your rights due to inaccuracy of the registered information. If you failure to notify VNPAY or notify incompletely of any changes or inaccuracies in the personal data provided, you will be responsible for any errors, risks or losses arising (if any), including financial damages and additional costs due to incorrect or inconsistent information.

(ii) Cung cấp đầy đủ, trung thực, chính xác Dữ liệu cá nhân, các thông tin khác theo yêu cầu của VNPAY khi đăng ký và sử dụng sản phẩm, dịch vụ của VNPAY và khi có thay đổi về các thông tin này. VNPAY sẽ tiến hành bảo mật Dữ liệu cá nhân của Quý khách căn cứ trên thông tin Quý khách đã đăng ký. Do đó, nếu có bất kỳ thông tin sai lệch nào, VNPAY sẽ không chịu trách nhiệm trong trường hợp thông tin đó làm ảnh hưởng hoặc hạn chế quyền lợi của Quý khách. Trường hợp không thông báo hoặc thông báo không đầy đủ về sự thay đổi hoặc không chính xác của Dữ liệu cá nhân đã cung cấp cho VNPAY, Quý khách chịu mọi trách nhiệm về những sai sót, rủi ro, tổn thất phát sinh (nếu có), bao gồm cả thiệt hại về tài chính, chi phí phát sinh do thông tin cung cấp sai hoặc không thống nhất.

(iii) To cooperate with VNPAY, competent state authorities, or third parties if there are any issues affecting your personal data.

(iii) Phối hợp với VNPAY, cơ quan nhà nước có thẩm quyền hoặc bên thứ ba trong trường hợp phát sinh các vấn đề ảnh hưởng đến Dữ liệu cá nhân của Quý khách.

(iv) To protect your own personal data; proactively implement appropriate measures to safeguard your personal data when using VNPAY's products and services; promptly inform VNPAY upon discovering inaccuracies or suspicions regarding the infringement of the personal data.

(iv) Tự bảo vệ Dữ liệu cá nhân của Quý khách; chủ động áp dụng các biện pháp nhằm bảo vệ Dữ liệu cá nhân của mình trong quá trình sử dụng sản phẩm, dịch vụ của VNPAY; thông báo kịp thời cho VNPAY khi phát hiện thấy có sai sót, nhầm lẫn về Dữ liệu cá nhân của mình hoặc nghi ngờ Dữ liệu cá nhân của mình đang bị xâm phạm.

(v) To assume responsibility for the information, data, and consent you create or provide; to take responsibility in cases where personal data leakage or infringement occurs due to your faults.

(v) Tự chịu trách nhiệm đối với những thông tin, dữ liệu, chấp thuận mà mình tạo lập, cung cấp; tự chịu trách nhiệm trong trường hợp Dữ liệu cá nhân bị rò rỉ, xâm phạm do lỗi của mình.

(vi) To regularly update on the regulations and policies regarding personal data protection that VNPAY notifies you from time to time or publishs on VNPAY's official website (vnpay.vn) or VNPAY e-wallet application; to follow VNPAY's instructions to clearly indicate your full consent, partial consent, conditional consent, or non-consent regarding contents that VNPAY notifies you from time to time.

(vi) Thường xuyên cập nhật các quy định, chính sách về bảo vệ Dữ liệu cá nhân VNPAY thông báo tới Quý khách trong từng thời kỳ hoặc đăng tải trên trang thông tin điện tử chính thức của VNPAY (vnpay.vn) hoặc ứng dụng Ví VNPAY; thực hiện các hành động theo hướng dẫn của VNPAY để thể hiện rõ việc đồng ý toàn bộ hoặc đồng ý một phần hoặc đồng ý với điều kiện kèm theo hoặc không đồng ý đối với các nội dung VNPAY thông báo tới Quý khách trong từng thời kỳ.

(vii) To respect and protect the personal data of others.

(viii) To fulfill other obligations as stipulated by law.

Your continued use of VNPAY's products and services shall be construed that you accept the updated Personal Data Protection Policy.

VNPAY khuyến nghị Quý khách nên thường xuyên kiểm tra Chính sách Bảo vệ Dữ liệu cá nhân trên trang thông tin điện tử chính thức của VNPAY (vnpay.vn) để cập nhật các thay đổi và luôn được VNPAY thông báo về cách thức bảo vệ Dữ liệu cá nhân của Quý khách. Việc Quý khách tiếp tục sử dụng sản phẩm, dịch vụ của VNPAY được hiểu là Quý khách đã chấp nhận bản Chính sách Bảo vệ Dữ liệu cá nhân được cập nhật.
